Every Week Fantasy is a shared ledger for fantasy players or individuals to keep track of challenges created between players of connected leagues. Debts and payments recorded on Every Week Fantasy are informal records, and not legally binding contracts of some kind. We offer Every Week Fantasy service "as-is" without a warranty. Our platform is a work-in-progress, therefore some features of our website and apps may not work exactly as planned. We may stop offering or restrict certain services or features at any time.
We will modify this Terms of Services and our Privacy Policy periodically and post the most current version on https://everyweekfantasy.com/. By entering this page and using our platform you agree to be bind by these terms of services and our privacy policy.
Terms Of Use
Users
You may use our services only if you agree to these Terms of Service and to the processing of your information as described in our Privacy Policy. You may not use on Every Week Fantasy if you are barred from receiving services under the laws of the applicable jurisdiction, if we previously banned your account for violation of these terms, or if you are under the age of 15.
Service Description
Every Week Fantasy is a service designed to help you track informal debts and payments, by allowing users to enter notes about who they owe, who owes them and why, based on challenges created by users (fantasy players). The Service keeps track of the sharing math, provides informal sharing advice, and stores this data for later use. You agree that this service is provided AS-IS and on an AS AVAILABLE basis.
User-Generated Content
The website allows users who share a group (league) or are friends on the service to post debts and payments as they please, using wiki-style rules with no explicit permissions. These are calculated into a determination of debts by the Service. You agree that you understand these debts are not legally binding, and represent informal information sharing among roommates, friends, or family. You agree that the Service cannot guarantee the accuracy of information entered by users.
Acceptable Use
You agree that you will use the Service for its intended purpose, and in compliance with all applicable laws and regulations: local, state, and national, and international, as applicable. You agree not to use the service in a fraudulent, disruptive, aggressive, manipulative, for money laundering, or any other inappropriate matter. Every Week Fantasy reserves the right, but has no obligation, to investigate your use of the service for compliance with appropriate use and terminate your access to the Service, or in order to comply with law, regulation, legal process or government request.
User Representations
You agree to represent yourself honestly, that all of the information you provide is true, correct, and current, to the best of your knowledge, and that you have the necessary rights, power, authority, and age to agree to these Terms and to perform the acts required of you by the agreement.
Service Disclaimer
Every Week Fantasy does not represent that the Service is error-free, complete, or can be relied upon. THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITH NO WARRANTY OF ANY KIND AND YOU ARE USING THE SERVICE AT YOUR OWN RISK. EVERY WEEK FANTASY DISCLAIMS ANY WARRANTY, IMPLIED OR OTHERWISE, REGARDING THE SERVICE, INCLUDING WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Termination
Your access to the Service may be terminated at any time, for any reason, at Every Week Fantasy's sole discretion. This includes the right to ban any person from the service who violates Every Week Fantasy's policies.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL EVERY WEEK FANTASY, ITS SHAREHOLDERS, EMPLOYEES, DIRECTORS, OR REPRESENTATIVES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING EMOTIONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL EVERY WEEK FANTASY, ITS SHAREHOLDERS, EMPLOYEES, DIRECTORS, OR REPRESENTATIVES BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED PURSUANT TO THIS AGREEMENT.
Indemnification
You agree to hold Every Week Fantasy, its shareholders, employees, agents, directors and representatives, as harmless and indemnify Every Week Fantasy, from any third party claim arising from or in any way related to your use of the Service, including liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorney fees, of every kind and nature.
Modifications
You agree that Every Week Fantasy may modify this agreement at any time, effective immediately, by posting a new agreement. You agree that even if you have not personally visited the website with the new terms of this agreement, that they may have force immediately.
Severability
In case any provision of these Terms of Service is held to be invalid, illegal or unenforceable, such provision shall be severable from the rest of these Terms of Service, and the validity, legality and enforceability of the remaining provisions and these Terms of Service shall not in any way be affected or impaired.
Waiver
If Every Week Fantasy does not exercise or enforce any part of this agreement and terms does not constitute a waiver of the rights of provisions of this agreement.
Governing Law
For the interpretation, performance and enforcement of this Agreement, each of the parties hereto hereby irrevocably submits to the laws and jurisdiction of the competent federal courts located in Mexico City, Mexico, and expressly waives any other jurisdiction it may be entitled to now or hereafter, by reason of its present or future domicile or for any other reason.
Entire Agreement
This Terms of Service sets forth the entire agreement and understanding of the parties in respect to the transactions contemplated herein, and supersedes all prior written or oral communications in respect to such transactions.

Terminación

BAJO NINGUNA CIRCUNSTANCIA EVERY WEEK FANTASY, SUS ACCIONISTAS, EMPLEADOS, DIRECTORES O REPRESENTANTES SERÁN RESPONSABLES ANTE USTED POR CUALQUIER MONTO POR SERVICIOS PRESTADOS CONFORME A ESTE ACUERDO.
Indemnización
Usted acepta mantener a Every Week Fantasy, sus accionistas, empleados, agentes, directores y representantes indemnes y a indemnizar a Every Week Fantasy, de cualquier reclamo de terceros que surja de o esté de alguna manera relacionado con su uso del Servicio, incluyendo la responsabilidad o los gastos que surjan de todos los reclamos, pérdidas, daños (reales y consecuentes), juicios, costos de litigio y honorarios de abogados, de todo tipo y naturaleza.
Modificaciones
Usted acepta que Every Week Fantasy puede modificar este acuerdo en cualquier momento, con efecto inmediato, al publicar un nuevo acuerdo. Usted acepta que incluso si no ha visitado personalmente el sitio web con los nuevos términos de este acuerdo, estos pueden tener vigencia de inmediato.
Divisibilidad

Ley Aplicable
Para la interpretación, el cumplimiento y la aplicación de este Acuerdo, cada una de las partes se somete irrevocablemente a las leyes y la jurisdicción de los tribunales federales competentes ubicados en la Ciudad de México, México, y renuncia expresamente a cualquier otra jurisdicción a la que pueda tener derecho ahora o en el futuro, debido a su domicilio actual o futuro o por cualquier otra razón.
Acuerdo Completo
Este Término de Servicio establece el acuerdo completo y el entendimiento de las partes con respecto a las transacciones contempladas en el presente, y reemplaza todas las comunicaciones escritas u orales anteriores con respecto a dichas transacciones.
